Binding Arbitration Services refers to a procedure by which parties agree to submit their dispute(s) to a neutral third party, an arbitrator. The arbitrator considers arguments and evidence from all sides, and then renders a written final and binding decision.

Code of Ethics and Standards of Practice of

The National Association of Realtors®

Effective January 1, 2020, Article 17 reads as follows:

 In the event of contractual disputes or specific non-contractual disputes as defined in Standard of Practice 17-4 between Realtors® (principals) associated with different firms, arising out of their relationship as Realtors®, the Realtors® shall mediate the dispute if the Board requires its members to mediate. If the dispute is not resolved through mediation, or if mediation is not required, Realtors® shall submit the dispute to arbitration in accordance with the policies of the Board rather than litigate the matter. In the event clients of Realtors® wish to mediate or arbitrate contractual disputes arising out of real estate transactions, Realtors® shall mediate or arbitrate those disputes in accordance with the policies of the Board, provided the clients agree to be bound by any resulting agreement  or award. The obligation to participate in mediation and arbitration contemplated by this Article includes the obligation of Realtors® (principals) to cause their firms to mediate and arbitrate and be bound by any resulting agreement or award. The Association of Realtors generally does not arbitrate conflict involving same-company disputants. Real Estate Arbitration Service specializes in the resolution of these cases.

Leonard Newman is actively involved in Alternative Dispute Resolution, directing a private mediation practice specializing in real estate disputes. His unique qualification as a real estate Arbitrator stems from over 20 years as a Real Estate Practitioner. Newman’s experience and contract knowledge are the result of his transacting and managing over one-half billion dollars in real estate sales since 2008.



Although Newman has a rich background in Real Estate, he also is versed in business and social ADR. Newman regularly conducts mediations for the Orange County Superior Courts, involving civil harassment cases and financial disputes.

Bryan Zuetel, Esq. has been practicing real estate law for 10 years and has been involved in real estate for over 15 years. Mr. Zuetel has extensive experience in negotiations, contract solutions, conflict resolution, arbitration, mediation, and real estate transactions. Mr. Zuetel is a panel member of the Orange County Association of Realtors (OCAR) Professional Standards Committee hearing ethics complaints and fee dispute arbitrations. Real Estate Arbitration Service

The hourly and daily rates of arbitrator neutrals vary depending on the panelist selected. Neutrals are independent contractors and set their rates. Fees are split equally between all parties, unless the parties agree otherwise. All payments must be received before the issuance of an award.  The Initial Scheduling Consultation Fee and the Arbitration Hearing fee shall be paid in advance. Notice of cancellation or rescheduling shall be submitted in writing. 

FILING FEE $500

Due at the time of filing Demand or Stipulation for Arbitration 

 

INITIAL SCHEDULING CONSULTATION FEE $500

(Call with the arbitrator and parties to set the stage for the case, any discovery or motions, and set arbitration hearing date) 

DUE 5 days before the initial scheduling conference call.


ARBITRATION HEARING FEE $1,500

(includes 4 hours of arbitrator time) (preparation for and conducting the arbitration hearing, post-hearing, preparation of arbitration award) 

Due fifteen (15) days before the scheduled arbitration hearing *Refundable if arbitration is cancelled at least five (5) days before the scheduled arbitration hearing date, except for time billed and expenses.

ARBITRATOR FEE 

(for additional arbitrator work) 

Due within thirty (30) days of billing *Not applicable if arbitrator logs 4 hours or less on the matter 

At arbitrator’s hourly rate.

 

ADDITIONAL ARBITRATOR FEES

Review of motion papers, hearing motions, and preparation for ruling on motions.
